Welcome to Swipe Photo Cleaner. These Terms of Service ("Terms") govern your use of the Swipe Photo Cleaner mobile application (the "App") operated by vishwesh789 ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.
By accessing or using Swipe Photo Cleaner, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the App on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
You must be at least 13 years of age to use this App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18 years of age, you must have your parent or legal guardian's permission to use the App.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device solely for your personal, non-commercial use.

You retain all rights, title, and ownership to your photos and any other content you process through the App. We do not claim any ownership rights to your photos.
The App processes all photos locally on your device. We do not upload, store, or transmit your photos to our servers or any third-party servers. All photo analysis, categorization, and organization occur entirely on your device.
The App requires access to your device's photo library to function. By granting this permission, you authorize the App to read, analyze, and modify photos in your library as directed by you through the App's features.
When you mark photos for deletion in the App, they are moved to a "Trash" folder and retained for 30 days. During this period, you can restore deleted photos at any time.
After 30 days in the Trash folder, photos are permanently deleted from your device and cannot be recovered. You may also manually trigger permanent deletion at any time through the App's "Empty Trash" feature.
You acknowledge that once photos are permanently deleted, they cannot be recovered. We are not responsible for any loss of photos resulting from your use of the deletion features, whether accidental or intentional.
The App offers both free and premium features. Premium features require an active subscription, which may be offered on a weekly or annual basis.
You can manage and cancel your subscription at any time through your Apple App Store or Google Play Store account settings. Cancellation will take effect at the end of the current billing period.
All purchases are processed through the Apple App Store or Google Play Store. Refund requests must be submitted directly to Apple or Google according to their respective refund policies. We do not have the ability to process refunds directly.
We may offer free trial periods for premium subscriptions. If you do not cancel before the trial period ends, you will be automatically charged for the subscription.

Your use of these third-party services is governed by their respective terms of service and privacy policies. We are not responsible for the practices of these third parties.
The App, including its design, features, functionality, code, and content (excluding your photos), is owned by vishwesh789 and is protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written permission.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the App's AI-powered features (such as blur detection, duplicate detection, or smart categorization) will be 100% accurate. You should review all deletion decisions before permanently removing photos.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
In no event shall our total liability to you for all damages exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.
You agree to indemnify, defend, and hold harmless vishwesh789 and its affiliates, officers, agents, and employees from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:
We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the App.
We may update these Terms from time to time. When we make material changes, we will notify you by updating the "Last Updated" date at the top of these Terms and, where appropriate, by providing notice through the App or via email. Your continued use of the App after such changes constitutes your acceptance of the updated Terms.
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.
These Terms shall be governed by and construed in accordance with the laws applicable in your jurisdiction, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through good faith negotiation. If negotiation fails, disputes may be submitted to binding arbitration or the courts of competent jurisdiction as determined by applicable law.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and vishwesh789 regarding the App and supersede all prior agreements and understandings, whether written or oral.
