Welcome to MTG Card Scanner ("the App," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our mobile application. By downloading, installing, or using the App, you agree to be bound by these Terms.

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.

1. Acceptance of Terms

By accessing or using MTG Card Scanner, you affirm that you:

• Are at least 13 years of age
• Have the legal capacity to enter into this agreement
• Will comply with all applicable laws and regulations
• Have read and agree to our Privacy Policy

If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. License to Use the App

2.1 Grant of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device solely for your personal, non-commercial use.

2.2 Restrictions

You may NOT:

• Copy, modify, reverse engineer, decompile, or disassemble the App
• Distribute, sell, lease, rent, lend, or sublicense the App
• Remove, alter, or obscure any copyright, trademark, or proprietary notices
• Use the App for any illegal, fraudulent, or unauthorized purpose
• Attempt to gain unauthorized access to the App or its systems
• Use automated scripts, bots, or scrapers to access the App
• Interfere with or disrupt the App's functionality or servers
• Circumvent any limitations, restrictions, or usage limits

3. Account and Subscriptions

3.1 Free and Premium Tiers

The App offers both free and premium subscription tiers:

3.2 Subscription Plans

Premium subscriptions are available in the following plans:

• Weekly Subscription
• Monthly Subscription
• Annual Subscription

Pricing is displayed in the App and may vary by region and currency. All prices include applicable taxes.

3.3 Payment and Billing

• All payments are processed through the Apple App Store (iOS) or Google Play Store (Android)
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage or cancel your subscription through your App Store/Play Store account settings
• No refunds will be provided for partial subscription periods

3.4 Free Trial (If Applicable)

If we offer a free trial:

• The trial period will be clearly stated at the time of subscription
• You will be charged automatically when the trial ends unless you cancel before the trial period expires
• Cancel anytime during the trial to avoid charges

3.5 Subscription Changes

We reserve the right to:

• Modify subscription pricing with 30 days' notice
• Change features included in subscription tiers
• Discontinue subscription plans (existing subscribers will be notified)

4. Refund Policy

All purchases are subject to the refund policies of the Apple App Store and Google Play Store:

• iOS: Refund requests must be made through the App Store. Visit Apple Support
• Android: Refund requests must be made through Google Play. Visit Google Play Help

We do not have the ability to process refunds directly. Please contact the respective platform for refund inquiries.

5. User Content and Conduct

5.1 Your Content

You retain ownership of all content you create in the App, including:

• Card collections and deck lists
• Personal notes and annotations
• Custom deck names and descriptions

By using the App, you grant us a limited license to store and process your content solely for the purpose of providing App functionality.

5.2 Prohibited Conduct

You agree NOT to:

• Use the App to cheat, deceive, or gain unfair advantage in gameplay
• Share, sell, or distribute account access or premium features
• Upload malicious code, viruses, or harmful content
• Harass, abuse, or harm other users (if social features are added)
• Impersonate others or misrepresent your affiliation
• Use the App for commercial purposes without authorization
• Violate any local, state, national, or international law

6. Intellectual Property

6.1 App Ownership

The App, including all software, code, design, features, and functionality, is owned by us and protected by copyright, trademark, and other intellectual property laws.

6.2 Magic: The Gathering Trademarks

Magic: The Gathering, MTG, and all associated card names, images, and content are trademarks and copyrights of Wizards of the Coast LLC, a subsidiary of Hasbro, Inc.

This App is not affiliated with, endorsed, or sponsored by Wizards of the Coast. All card data is sourced from publicly available databases (Scryfall API).

6.3 Third-Party Content

Card images, text, and data are provided by third-party sources (Scryfall) and remain the property of their respective owners. We do not claim ownership of any MTG card content.

7. Price Information and Disclaimers

Price information should NOT be relied upon for:

• Determining the actual market value of cards
• Making financial or investment decisions
• Insurance claims or appraisals
• Legal or tax purposes

Card prices fluctuate frequently based on market conditions, demand, condition, and other factors. Always consult reputable dealers and marketplaces for current pricing.

8. Third-Party Services

The App integrates with third-party services, including:

• Scryfall API (card database)
• OpenAI Vision API (card recognition)
• RevenueCat (subscription management)
• Firebase (analytics and crash reporting)

Your use of these third-party services is subject to their respective Terms of Service and Privacy Policies. We are not responsible for the availability, accuracy, or content provided by third-party services.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Accuracy, reliability, or completeness of content
• Uninterrupted, error-free, or secure operation
• Compatibility with all devices or operating systems

We do not warrant that:

• The App will meet your requirements or expectations
• Card recognition will be 100% accurate
• Data will be backed up or preserved
• Defects will be corrected promptly

YOU USE THE APP AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Business interruption or loss of business opportunity
• Errors in card recognition or data
• Inaccurate price information
• Loss of card collection data due to device failure, app errors, or user actions
• Third-party service interruptions or failures

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold us harmless from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from:

• Your use or misuse of the App
• Violation of these Terms
• Violation of any third-party rights
• Your content or conduct

12. Data Backup and Loss

You are solely responsible for backing up your data:

• Use the Export feature (Premium) to save your collection data
• Keep backups of exported CSV/JSON files
• We are not responsible for data loss due to app errors, device failure, or uninstallation

13. Service Interruptions and Changes

We reserve the right to:

• Modify, suspend, or discontinue the App (or any features) at any time
• Perform maintenance or updates without notice
• Change, add, or remove features
• Limit access to certain features or users

We will make reasonable efforts to notify users of significant changes or discontinuation.

14. Termination

14.1 Termination by You

You may stop using the App at any time by uninstalling it from your device. To cancel your subscription, follow the instructions in your App Store/Play Store account.

14.2 Termination by Us

We reserve the right to suspend or terminate your access to the App if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your actions harm other users or the App
• Required by law or legal process

14.3 Effect of Termination

Upon termination:

• Your license to use the App ends immediately
• You must uninstall the App
• We are not obligated to retain your data
• Subscription fees are non-refundable

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law principles.

15.2 Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

1. Informal Negotiation: Contact us first to attempt resolution
2. Mediation or Arbitration: If negotiation fails, disputes may be subject to binding arbitration

15.3 Class Action Waiver

To the extent permitted by law, you agree to resolve disputes individually and waive the right to participate in class action lawsuits.

16. Changes to These Terms

We may update these Terms from time to time. When we make changes:

• The "Last Updated" date will be revised
• We will notify you through the App or via push notification
• Continued use of the App after changes constitutes acceptance

If you do not agree to the updated Terms, you must stop using the App.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App and supersede all prior agreements.
