1. Agreement to Terms

Welcome to YuGiOh Scanner ("we," "our," "us," or the "App"). These Terms of Service ("Terms") govern your use of our mobile application YuGiOh Scanner (the "Service") operated by Vishwesh Pratap Singh.

These Terms apply to all visitors, users, and others who access or use the Service.

YuGiOh Scanner is a mobile application that provides:

The App is designed for personal use to help users organize and manage their Yu-Gi-Oh trading card collections.

3. User Accounts and Registration

3.1 Account Creation

Currently, YuGiOh Scanner does not require user account creation. All data is stored locally on your device.

3.2 User Responsibilities

You are responsible for:

• Maintaining the confidentiality of your device and app data
• All activities that occur under your use of the App
• Backing up your collection data as needed
• Keeping your app updated to the latest version

4. Acceptable Use Policy

4.1 Permitted Uses

You may use the App for:

4.2 Prohibited Uses

• Uploading or transmitting viruses or any other type of malicious code
• Collecting or tracking the personal information of others
• Spamming, phishing, pharming, pretext, spider, crawl, or scrape
• Any obscene or immoral purpose
• Interfering with or circumventing the security features of the App

5. Intellectual Property Rights

5.1 App Ownership

The App and its original content, features, and functionality are and will remain the exclusive property of Vishwesh Pratap Singh and its licensors. The App is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

5.2 Third-Party Content

Yu-Gi-Oh! is a trademark and intellectual property of Konami Digital Entertainment Co., Ltd. This App is not affiliated with, endorsed by, or connected to Konami or any official Yu-Gi-Oh! entities.

• Card Images: All Yu-Gi-Oh card images are the property of Konami and are used under fair use for identification purposes
• Card Data: Card information is sourced from publicly available databases and APIs
• Pricing Data: Market prices are provided by third-party services for informational purposes only

5.3 User-Generated Content

Any content you create within the App (collection lists, deck builds, notes) remains your property. However, you grant us a non-exclusive license to use, modify, and display such content solely for the purpose of providing and improving the App's functionality.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL YUGIOH SCANNER, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the App
• Any conduct or content of any third party on the App
• Any content obtained from the App
• Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL OUR LIABILITY EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICES.

10. Indemnification

You agree to defend, indemnify, and hold harmless YuGiOh Scanner and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

• Your use and access of the App
• Your violation of any term of these Terms
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right
• Any claim that your use of the App caused damage to a third party

11. Termination

11.1 Termination by You

You may terminate your use of the App at any time by simply uninstalling the application from your device. Upon termination, all locally stored data will be removed.

11.2 Termination by Us

We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

11.3 Effect of Termination

Upon termination, your right to use the App will cease immediately. All provisions of the Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be interpreted and enforced in accordance with the laws of India, without regard to conflict of law provisions.

12.2 Dispute Resolution

Any dispute arising from these Terms will be resolved through:

1. Informal Resolution: We encourage you to contact us first to seek a resolution
2. Binding Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration
3. Class Action Waiver: You agree that any arbitration will be conducted in your individual capacity only and not as a class action

12.3 Jurisdiction

You and YuGiOh Scanner agree to submit to the personal jurisdiction of the courts located within India for the purpose of litigating all such claims or disputes.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days advance notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.

We will notify you of changes by:

• Posting updates within the App
• Updating the "Last Updated" date at the top of these Terms
• Providing in-app notifications for significant changes

14. Severability and Waiver

14.1 Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

14.2 Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

15. Entire Agreement

These Terms and our Privacy Policy constitute the sole and entire agreement between you and YuGiOh Scanner regarding the App and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the App.
