These Terms of Service (“Terms”) govern your use of the NextGen Bar Prep mobile application (“App”). By using the App you agree to these Terms.
1. Acceptance of Terms
By downloading, installing, or using NextGen Bar Prep you agree to be bound by these Terms. If you do not agree, do not use the App.
2. Description of Service
NextGen Bar Prep is a study-aid application designed to help users prepare for the NextGen bar examination administered in participating United States jurisdictions. It provides practice multiple-choice questions, integrated question sets, performance tasks, flashcards, study notes, mock exams, and progress tracking. All content is for educational purposes only and is not a substitute for official bar-examination preparation materials, law school instruction, or legal advice.
3. Independent App — No NCBE Affiliation
NextGen Bar Prep is an independent study app and is not affiliated with, endorsed by, or sponsored by the National Conference of Bar Examiners (NCBE) or any state bar admission authority. NCBE®, NextGen UBE®, and UBE® are trademarks of the National Conference of Bar Examiners.
All practice questions and study materials in the App are original works, independently authored. They are not actual, retired, or licensed examination questions. For official information about the NextGen bar exam, consult NCBE and the bar admission authority in your jurisdiction.
4. User Eligibility
You must be at least 13 years old to use this App. By using the App you represent that you meet this requirement.
5. Subscriptions and Payments
The App offers optional premium subscriptions:
- Weekly subscription with a 3-day free trial
- Annual subscription
Subscriptions are billed through Apple’s In-App Purchase system and are subject to Apple’s own terms and refund policies.
Free trial: Your paid subscription begins automatically at the end of the free-trial period unless you cancel at least 24 hours before it expires. You can manage or cancel your subscription at any time through your Apple ID settings.
Auto-renewal: Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period. The renewal charge is the same as the original subscription price.
6. Content Accuracy, No Legal Advice, No Guarantee of Results
While we strive for accuracy, we do not guarantee that the content is complete, current, or free from errors. The law, and the format and policies of the bar examination, change over time; always verify important details with NCBE and your jurisdiction’s bar admission authority.
Nothing in the App constitutes legal advice, and your use of the App does not create an attorney–client relationship. Use of the App does not guarantee that you will pass the bar examination or achieve any particular score.
7. User Responsibilities
You agree not to:
- Copy, redistribute, or resell the App or its content
- Reverse-engineer, decompile, or modify the App
- Use the App for any unlawful purpose
- Attempt to circumvent subscription payments or access controls
8. Intellectual Property
All content, design, and code within NextGen Bar Prep are the intellectual property of NextGen Bar Prep and are protected by applicable copyright and intellectual-property laws. Nothing in these Terms grants you any right to use the NextGen Bar Prep name, logos, or trademarks.
NCBE®, NextGen UBE®, and UBE® are trademarks of the National Conference of Bar Examiners, which does not sponsor or endorse this App. They are used here solely to identify the examination the App helps users prepare for.
9. Disclaimer of Warranties
NextGen Bar Prep is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the fullest extent permitted by law, NextGen Bar Prep shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, revenue, anticipated savings, or examination outcomes.
11. Termination
We reserve the right to suspend or terminate your access to the App at any time if you breach these Terms. Upon termination, your right to use the App ceases immediately.
12. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
